COURT OF APPEAL NULLIFIES MOVEMENT RESTRICTION.

The Court of Appeal, Lagos judicial division, has finally declared as illegal and unconstitutional the restriction on movement of persons during environmental Saturdays in Lagos.

Delivering judgement yesterday, November 4, 2016 on the suit filed by Faith Okafor against the Lagos state attorney general challenging the legality of the restriction, the Court held that the order by the governor of Lagos state was unlawful and contravenes the Nigerian constitution.

In effect, until this ruling is overturned at the Supreme Court, it is illegal to restrict the movement of persons in Lagos state during the monthly environmental Saturdays between 7am and 10am.

The ruling also lays down the law that could also affect other States in the federation of Nigeria where by fiat or directive, government had restricted movement of persons within the same hours on particular days to ensure stay at home to actively participate in cleaning of the environment.

Many states in the federation adopted last Saturday of each month as days dedicated to cleaning of the environment and have been restricting movement of persons within the period

Lagos state also set aside Thursdays as market cleaning days for traders and so, none was expected to open shops or display wares before 10am. No accompanying restrictions though on movement of persons.
